  2. Complaints of the purchaser about the seller and its activity in connection with the purchase contract can be addressed to (shop@promed.de, fax: 08821-9621-21). The complaints will be processed within a reasonable period. The seller seeks to reach a consensus with the purchaser in order to resolve the complaint.

  3. The seller shall be liable for defects as to quality or title of the supplied articles under the applicable statutory stipulations, in particular §§ 434 et seqq. BGB [German Civil Code]. The period of limitation for statutory claims based on defects shall amount to two years and shall start upon the delivery of the goods.

  4. Beyond our normal services, we also offer a customer service and/or repair service for a various product areas which you can make use of if repairs are necessary, provided that this has not already been settled within the framework of guarantee claims. The costs possibly incurred can be enquired about with our service hotline in advance.

  5. Technical steps for the conclusion of the contract: By clicking on the button “zahlungspflichtig bestellen” [commit to buy], your purchase order (i.e. your offer to purchase) is transmitted to us. Afterwards, you will receive an electronic confirmation of the receipt of your purchase order from us. After examining your purchase order, we will decide whether to accept your purchase order. Afterwards, we will either send you a declaration of acceptance (including the information prescribed by law) or a refusal. The conclusion of the desired purchase contract shall only be effected by the receipt of the declaration of acceptance.

  6. The text of the contract will be stored by us after the conclusion of the contract and made accessible to you in accordance with the statutory stipulations.

  7. Before you click on the button “zahlungspflichtig bestellen” [commit to order], you will be shown an overview of your purchase order. This overview shows all goods that are part of the purchase order, the number of goods, the respective unit price and the total price. You can return from this overview to your basket by clicking on the button “Zurück zum Warenkorb” [return to basket]. In your basket, you can either completely delete an article or change the number of the goods to be ordered.

  8. The conclusion of the contract is only possible in German language.

  9. Terms of guarantee:
    This product was manufactured with utmost care and was thoroughly examined prior to leaving the factory. For this reason, we provide a guarantee of 24 months from the purchase date for this product. Promed products comply with their description and the respective specifications; it is your responsibility to make sure that the products bought by you are designed for your intended use.

                    •   In the case of verifiable material and/or manufacturing faults that occur during the approved use and are detected during the guarantee period, we shall replace all defective parts of the product during the guarantee period free of charge, including the labour costs of the guarantee repairs.

                    •   The guarantee shall not cover:

                    •   Normal wear and tear of the product

                    •   Defects caused by the transport and the storage of the product

                    •   Defects or damage caused by improper use or defective maintenance

                    •   Damage due to a failure to comply with the notes in the operating manual

                    •   Damage due to modifications of the product not carried out by Promed.

                    •   Damage by sharp objects, as a consequence of torsion, compression, falling, abnormal percussion or other acts outside of the reasonable control of Promed.

                   •    Wear parts (e.g. movable parts such as ball bearings, etc., locks) shall be excluded from the guarantee on principle.

                   •    A guarantee claim cannot be enforced if:

                   •    The product is not returned in its original packaging or an adequately secure packaging,

                  •     It was modified or repaired by another person or company, except for Promed or an authorised Promed dealer;

                  •     The product was repaired using replacement parts not approved by Promed;

                  •     The serial number of the product was removed, deleted, changed or made illegible.

                  •     For hygienic reasons, products exposed to a direct physical contact and/or a contact with bodily fluids (e.g. blood) must be packed in an extra plastic bag prior to the return shipment. In these cases, special reference must be made to this fact on the packet and/or in the accompanying documents.

                 •     For components repaired during the guarantee period or replaced products, the guarantee shall only be granted for the remaining original guarantee period; provided that this replacement or this repair was carried out by Promed or an authorised Promed dealer.

                  •     The guarantee period shall start on the day of purchasing. Guarantee claims must be asserted within the guarantee period. Complaints made after the expiry of the guarantee period cannot be considered.

                  •     Within the framework of these terms of guarantee, the guarantee shall only take effect if the purchase date is proven by means of a proof of purchase or a similar document.

                  •     We reserve the right to make technical and optical changes and changes of the features!

                  •     This guarantee shall only be legally valid and enforceable in the country where the product was purchased by the initial purchaser, provided that it was Promed’s intention that this product is offered for sale in such country. This guarantee shall also be enforceable in any country of the European Economic Area where Promed has an authorised importer or distribution partner. Depending on the respective country, special and differing guarantees and warranties may be relevant due the respectively applicable legislation. Those statutory provisions shall neither be excluded nor limited due to these terms of guarantee. To the extent that it is admissible by national law, the guarantee period shall not be extended, renewed or otherwise affected by a subsequent resale, a repair or a replacement of the product.

                  •    The provisions of the UN Sales Convention shall not apply.

                  •    The statutory warranty obligation of the seller shall not be affected by our terms of guarantee.

                  •    To the greatest extent possible under the applicable mandatory legislation, these terms of guarantee shall constitute your sole and exclusive remedy and shall apply instead of all other express or implied terms of guarantee. Promed shall not be liable for unusual, incidental, punitive or consequential damages, including, but without limitation, lost profit, loss of use, loss of income, costs for replacement equipment or facilities, third-party insurance claims, damage to property arising due to the acquisition or use of the product or due to a violation of guarantee, a breach of contract, negligence, product defects or other legal or statutory circumstances even if Promed knew of the possibility of such damage. Promed shall not be liable for a delay in claiming guarantee services.

                   •    Promed cannot be held liable for possible translation errors.
